Terms and Conditions for Accommodation

Article 1. Scope of Application

  1. Contracts for Accommodation and related agreements to be entered into between this Hotel and the Guest to be accommodated shall be subject to these Terms and Conditions. Any particulars not provided for herein shall be governed by laws and regulations (meaning laws or those based on laws and regulations; the same shall apply hereinafter) and/or generally accepted practices.
  1. In the case where the Hotel has entered into a special contract with the Guest, insofar as such special contract does not violate laws and regulations and generally accepted practices, notwithstanding the preceding paragraph, the special contract shall take precedence over the provisions of these Terms and Conditions.

Article 2. Application for Accommodation Contracts

  1. A Guest who intends to apply for an Accommodation Contract with the Hotel shall notify the Hotel of the following particulars:

(1) Name of the Guest(s) and contact information

(2) Date of accommodation

(3) Accommodation plan to be used

(4) Other particulars deemed necessary by the Hotel

  1. In the case where the Guest requests, during the stay, an extension of the accommodation beyond the date in Subparagraph 2 of the preceding paragraph, the Hotel shall treat it as an application for a new Accommodation Contract at the time such request is made.
  1. The accommodation plan to be used in Subparagraph 3 of the preceding paragraph shall be valid only at the time of application for the Accommodation Contract. If the Guest desires accommodation with a different accommodation plan from the one applied for, the Guest shall make a new application for an Accommodation Contract. The reservation made at the time of the initial application shall not be automatically canceled, so the Guest shall take separate necessary procedures.
  1. The Guest shall apply for the Accommodation Contract with the understanding that the status of the Accommodation Contract or Accommodation Reservation between the Guest and the Hotel, or the rights based on the Accommodation Contract, are prohibited from being assigned to a third party, except when explicitly approved by the Hotel, in order to prevent inappropriate resale and provide all guests with an appropriate opportunity for accommodation.
  1. The Guest shall apply for the Accommodation Contract with the understanding that applying for duplicate Accommodation Contracts on the same day by the same user without reasonable grounds, and for multiple accommodations on similar dates, is prohibited in order for the Hotel to provide accommodation opportunities to as many guests as possible.

Article 3. Conclusion of Accommodation Contracts, etc.

  1. A Contract for Accommodation shall be deemed to have been concluded when the Hotel has duly accepted the application as stipulated in the preceding Article. However, depending on the accommodation plan, the contract shall be deemed to have been concluded when the Guest has made a prepayment after the application in the preceding Article and the Hotel has confirmed the payment. This shall not apply if it has been proved that the Hotel has not accepted the application.

Article 4. Request for Cooperation in Infection Prevention Measures at the Facility

  1. The Hotel may request the cooperation of the person seeking accommodation, pursuant to the provisions of Article 4-2, Paragraph 1 of the Hotel Business Act (Act No. 138 of 1948).

Article 5. Refusal of Accommodation Contracts

  1. The Hotel shall have the right not to accept the conclusion of an Accommodation Contract under any of the following cases. However, this paragraph does not mean that the Hotel may refuse accommodation in cases other than those listed in Article 5 of the Hotel Business Act:

(1) When the application for accommodation does not conform to the provisions of these Terms and Conditions.

(2) When the Hotel is fully booked and no room is available.

(3) When the Guest seeking accommodation is deemed liable to conduct himself in a manner that would contravene the laws or act against the public order or good morals in regard to the accommodation.

(4) When the Guest seeking accommodation is deemed to fall under any of the following (a) through (c):

a) An Organized Crime Group as provided in Article 2, Paragraph 2 of the Act on Prevention of Unjust Acts by Organized Crime Group Members (Act No. 77 of 1991) (hereinafter referred to as “Organized Crime Group”), a member of an Organized Crime Group as provided in Article 2, Paragraph 6 of the same Act (hereinafter referred to as “a member of an Organized Crime Group”), a quasi-member of an Organized Crime Group, a person related to an Organized Crime Group, or other anti-social element.

b) A corporation or other entity whose business activities are controlled by an Organized Crime Group or a member of an Organized Crime Group.

c) A corporation whose directors include persons corresponding to a member of an Organized Crime Group.

(5) When the Guest seeking accommodation has made remarks or behaved in a manner that causes significant annoyance to other guests.

(6) When the Guest seeking accommodation is a patient of a specified infectious disease as provided in Article 4-2, Paragraph 1, Item 2 of the Hotel Business Act (hereinafter referred to as “patient of a specified infectious disease, etc.”).

(7) When violent demands or acts are made in relation to the accommodation, or an unreasonable burden exceeding a reasonable scope is requested (excluding cases where the Guest seeking accommodation requests the removal of social barriers under Article 7, Paragraph 2 or Article 8, Paragraph 2 of the Act for Eliminating Discrimination against Persons with Disabilities (Act No. 65 of 2013; hereinafter referred to as “Disability Discrimination Elimination Act”)).

(8) When the Guest seeking accommodation repeatedly makes demands to the Hotel which are stipulated in Article 5-6 of the Ordinance for Enforcement of the Hotel Business Act as demands whose implementation imposes an excessive burden and is likely to significantly hinder the provision of accommodation services to other guests.

(9) When the Hotel is unable to provide accommodation due to natural calamities, malfunction of facilities, and/or other unavoidable causes.

(10) When the case falls under the provisions of the Prefectural Ordinance for Enforcement of the Hotel Business Act having jurisdiction over the Hotel facility.

  1. The Guest seeking accommodation may request an explanation of the reasons from the Hotel when the Hotel does not accept the conclusion of an Accommodation Contract based on the preceding Article.

Article 6. Right to Cancel Accommodation Contracts by the Guest

  1. The Guest is entitled to cancel the Accommodation Contract by so notifying the Hotel.
  1. The Guest may voluntarily cancel the Accommodation Contract by notifying the Hotel, except for plans where changes or cancellations are stipulated as not permitted in the cancellation policy. In this case, the Hotel shall charge cancellation charges in accordance with the cancellation policy as listed in the Attached Table No. 1.
  1. In the event that a Guest does not appear by 6 p.m. on the accommodation date (or 10 p.m. in the case of an Accommodation Contract without dinner) and has not notified the Hotel in advance, the Hotel may regard the Accommodation Contract as having been canceled by the Guest and process it accordingly.

Article 7. Right to Cancel Accommodation Contracts by the Hotel

  1. The Hotel may cancel the Accommodation Contract under any of the following cases. However, this paragraph does not mean that the Hotel may refuse accommodation in cases other than those listed in Article 5 of the Hotel Business Act:

(1) When the Guest is deemed liable to conduct or has conducted him/herself in a manner that would contravene the laws or act against the public order and good morals in regard to the accommodation.

(2) When the Guest is deemed to fall under any of the following (a) through (c):

a) An Organized Crime Group, a member of an Organized Crime Group, a quasi-member of an Organized Crime Group, a person related to an Organized Crime Group, or other anti-social element.

b) A corporation or other entity whose business activities are controlled by an Organized Crime Group or a member of an Organized Crime Group.

c) A corporation whose directors include persons corresponding to a member of an Organized Crime Group.

(3) When the Guest has made remarks or behaved in a manner that causes significant annoyance to other guests.

(4) When the Guest is a patient of a specified infectious disease, etc..

(5) When violent demands or acts are made, or a burden exceeding a reasonable scope is requested in relation to the accommodation (excluding cases where the Guest requests the removal of social barriers under Article 7, Paragraph 2 or Article 8, Paragraph 2 of the Disability Discrimination Elimination Act).

(6) When the Guest repeatedly makes demands to the Hotel which are stipulated in Article 5-6 of the Ordinance for Enforcement of the Hotel Business Act as demands whose implementation imposes an excessive burden and is likely to significantly hinder the provision of accommodation services to other guests.

(7) When the Hotel is unable to provide accommodation due to natural calamities, malfunction of facilities, or other unavoidable causes.

(8) When the case falls under the provisions of the Prefectural Ordinance for Enforcement of the Hotel Business Act having jurisdiction over the Hotel facility.

(9) When the Guest does not observe prohibited actions in the Accommodation Terms and Conditions or the Use Regulations stipulated by the Hotel.

(10) When the status of the Accommodation Contract or the rights based on the Accommodation Contract are deemed to have been assigned without the explicit approval of the Hotel.

(11) When an application for duplicate Accommodation Contracts on the same day by the same user without reasonable grounds or an application for multiple Accommodation Contracts on similar dates is deemed to have been made.

  1. The Guest may request an explanation of the reasons from the Hotel when the Hotel cancels the Accommodation Contract based on the preceding Article.

Article 8. Registration for Accommodation

  1. The Guest shall register the following particulars at the Front Desk of the Hotel on the day of accommodation:

(1) Name, age, sex, address, and phone number of the Guest(s).

(2) Nationality and passport number (if the Guest is not of Japanese nationality and does not have an address in Japan).

(3) Other particulars deemed necessary by the Hotel.

  1. In the case where the Guest intends to pay the charges in Article 11 by means other than currency, such as credit cards, the Guest shall present such instruments in advance to the Hotel at the time of registration as prescribed in the preceding paragraph.

Article 9. Occupancy Hours of Guest Rooms

  1. The hours during which the Guest can use the room at the Hotel shall be from the check-in time to the check-out time set for each Accommodation Contract. However, when the Guest is accommodated for a continuous number of days, the Guest may occupy the room for the entire day, except for the days of arrival and departure.
  1. The Hotel may, notwithstanding the provisions prescribed in the preceding paragraph, permit the Guest to occupy a room beyond the time prescribed in the same paragraph. In such case, the Guest shall pay additional charges.

Article 10. Observance of House Regulations

  1. The Guest shall observe the Use Regulations established by the Hotel, which are posted on the Hotel premises.

Article 11. Payment of Charges

  1. The breakdown of the accommodation charges is as follows:

Accommodation Charges, Extra Charges, Taxes, Service Fees.

  1. The Accommodation and other Charges referred to in the preceding paragraph shall be paid to the Hotel in currency or by means other than currency, such as credit cards, that are recognized by the Hotel, from the time the Accommodation Contract is concluded until the time of check-out or when the Hotel requests payment.
  1. Once accommodation facilities have been made available by the Hotel, the Accommodation Charges shall be paid even if the Guest voluntarily chooses not to utilize the facilities.

Article 12. Liabilities of the Hotel

  1. The Hotel shall compensate the Guest for any damage if the Hotel has caused such damage to the Guest in the course of its performance of, or by its non-fulfillment of, the Accommodation Contract and/or related agreements. However, this provision shall not apply in the event that such damage has been caused by a reason(s) not attributable to the Hotel.
  1. The Hotel is covered by Hotel Liability Insurance Policy relative to unexpected fires or other disasters.

Article 13. Handling when unable to provide Contracted Rooms

  1. The Hotel shall, when unable to provide the contracted rooms, arrange accommodation of the same standard elsewhere insofar as practicable with the consent of the Guest.
  2. When arrangement of other accommodations cannot be made notwithstanding the provisions of the preceding paragraph, the Hotel shall pay the Guest Compensation equivalent to the cancellation charges, and that compensation shall be applied to the amount of damages. However, if the Hotel’s inability to provide accommodation is not the result of a cause(s) attributable to the Hotel, the Hotel will not pay Compensation to the Guest.

Article 14. Handling of Deposited Articles, etc.

1.The Hotel shall compensate the Guest for damages to articles, money, and valuables the Guest has deposited at the Front Desk when said articles have been lost, broken or suffered other damage, except when the result of force majeure. However, when the Hotel has requested the Guest to report the type and value of cash and valuables and the Guest has failed to do so, the Hotel shall compensate the Guest for the loss up to a maximum of 100,000 yen.

  1. The Hotel shall compensate the Guest for damages to articles, money, and valuables the Guest has brought into the Hotel and has not deposited at the Front Desk, when damages including loss or breakage were caused intentionally or by gross negligence on the part of the Hotel. However, when the type and value of such items has not been reported in advance by the Guest, the Hotel shall compensate the Guest for the loss up to a maximum of 100,000 yen, except in cases where loss or damage was caused intentionally or by gross negligence on the part of the Hotel.

Article 15. Custody of Baggage or Belongings of the Guest

  1. When the baggage of the Guest is brought into the Hotel before the Guest’s arrival, the Hotel shall be liable to keep it only in the case when such a request has been accepted by the Hotel. The baggage shall be handed over to the Guest at the Front Desk at the time of check-in.
  1. When a Guest’s baggage or belongings are found to be left behind after checkout, and the owner is identified, the Hotel shall contact the owner and ask for instructions. However, if there are no instructions by the owner or the owner is not identified, the Hotel shall keep the items for seven days, including the day of discovery, and thereafter deliver them to the nearest police station.
  1. The Hotel’s liability in regard to the custody of the Guest’s baggage and belongings in the case of the preceding two paragraphs shall be assumed in accordance with the provisions of Paragraph 1 of the preceding Article in the case of Paragraph 1, and with the provisions of Paragraph 2 of the same Article in the case of the preceding paragraph.

Article 16. Handling of Carry-in Items, etc.

  1. If the Guest wishes to carry in a large amount of cash or valuables, the Hotel must be notified in advance due to security and other circumstances. Even if notified, the Hotel may refuse the carry-in at its discretion. Furthermore, the Hotel shall not be responsible for any damage, stain, or loss of large amounts of cash and valuables carried in without prior notification to the Hotel.
  1. Cash, valuables, baggage, or portable belongings carried in by the Guest shall be stored and managed by the Guest. Except when the Hotel has agreed to undertake the storage and management through a separate procedure, the Hotel shall only compensate for damage, stains, or loss if caused intentionally or by gross negligence on the part of the Hotel.
  1. Compensation for the preceding paragraph shall be made on the condition that the amount of damage is objectively proven. Regardless of the subjective value of the Guest, if the objective evaluation of the damage amount is difficult, the Hotel shall compensate a reasonable amount up to a maximum of 100,000 yen.

Article 17. Entry into Guest Rooms

  1. The Hotel may enter the guest room without the Guest’s permission even after the Guest has checked in, in the following cases:

(1) When providing Hotel services such as cleaning and room service.

(2) When the Guest is deemed liable to conduct or has conducted him/herself in a manner that would contravene the laws, Use Regulations, or act against the public order or good morals.

(3) When entry is deemed necessary in accordance with the guidance of the police or fire department.

(4) When deemed necessary for the preservation of the building and facilities.

(5) When the Hotel deems it necessary to confirm the safety and security of the Guest.

Article 18. Liability in regard to Parking

  1. When the Guest uses the parking lot of the Hotel, the Hotel is merely lending the space and does not assume responsibility for the management of the vehicle, regardless of whether the key(s) of the vehicle has been deposited with the Hotel. However, the Hotel will assume responsibility if damages are incurred through the management of the parking lot if such damages were caused by the intention or negligence of the Hotel.

Article 19. Liability of the Guest

  1. The Guest shall compensate the Hotel for damage caused through the intention or negligence of the Guest.
